Income through the company: salary minimised, value retained in the business or taken as benefits — met by reading the accounts as a whole: drawings, pension contributions, the lifestyle the declared income couldn’t fund. The convenient downturn: deferred invoicing, sudden pessimism, the “struggling” business whose owner’s spending never noticed — met by forensic accountants comparing the story with the bank statements. Parking: assets moved to relatives or new partners — met by tracing transfers, and by courts treating beneficial ownership as what it is. Geography and novelty: accounts abroad, crypto — harder work, not safe harbour. Simple omission: the forgotten account, remembered under interrogation.
The Machinery
It starts with the oath — the Affidavit of Means puts the whole position on sworn testimony — and escalates on evidence: interrogation of specific gaps, discovery reaching bank statements, company records and tax filings, forensic accountancy pricing lifestyle against declared means. The pattern evidence usually opens the door: courts have seen the suspiciously timed downturn a thousand times, and opacity invites exactly the inferences it fears.
What getting caught costs: adverse inferences (provision assessed on what evidence suggests exists), settlements reopened (concealment is the classic ground — in a system already without a clean break, hiding doesn’t even buy finality), costs orders, and credibility spent for the rest of the case.
