The fear arrives before the solicitor does: the farm will have to be sold. In most cases it doesn’t — courts have no appetite for destroying livelihoods or auctioning generations of family history — but “the land stays” is an outcome that gets built, not assumed. Here are the structures that build it.
The Toolkit
Provision from income: maintenance carried by what the farm actually produces — which makes honest farm accounts the foundation stone: provision must live within real cash flows, not paper acreage. Staged lump sums: raised by borrowing against the holding or paid over years, sized to what the enterprise can service. A site or non-core land: the transfer that gives real value without touching the working farm — often the piece that unlocks everything. The farmhouse dealt with separately: occupation or transfer arrangements for the home and its curtilage while the yard works on. Balancing from elsewhere: pensions, off-farm assets and savings doing the equalising the land can’t.
What Keeping the Land Costs
Honesty, mostly — in three currencies. Valuation honesty: the holding’s full worth (land, stock, machinery, entitlements) goes on the table; intact never means invisible. Income honesty: the accounts that plead poverty while the lifestyle says otherwise invite the forensic treatment, and lose the credibility the whole structure depends on. Contribution honesty: the spouse’s twenty years in the yard, on the books and in the home count directly — the settlement that respects them survives; the one that doesn’t gets fought, and fighting is how farms end up valued for sale.
Succession note: the next generation’s expectations are real features settlements can respect — but the mid-crisis transfer to a son or daughter reads exactly as it looks, and tends to be scrutinised rather than saluted.
